论民事既判力效力对司法公信力的影响

摘　　要：民事既判力效力包括本案效力和扩张性效力。本案效力具有终结诉讼的重要功能,其通过及时终结诉讼程序,维护司法裁判稳定的方式增强司法公信力。扩张性效力的突出功能在于协调诉讼机制内外关系,避免矛盾裁判和矛盾纠纷处理结果的产生,进而提升司法机制的公信力。民事既判力效力程序保障机制对于司法公信力亦有影响。充分的既判力生成程序和健全的既判力援引程序有利于司法公信力的提升,而既判力的击破程序与司法公信力则存在辩证关系,需要将该程序的启动控制在适度的范围。The civil judgement res judicata consists of the effectiveness to the case and the extended effectiveness. The effectiveness to the case can enhance public trust in judicature by ending litigation in time and maintaining the stability of judgments. The extended ef- fectiveness has an important function in coordinating inside and outside relations of lawsuit mechanism and avoiding contradietive judg ments and contradictive results so that public trust in justice mechanisms can be increased while the procedural safeguards mechanism of res judicata has the same effect on public trust in justice mechanisms. A sufficient procedure for res judicata to form and a sound procedure for res judicata to be invoked contribute to the promotion of public trust in justice mechanisms and the procedure to break res judicata should be started under some particular conditions while there is a dialectical relationship between trust in justice mechanisms and it.
