我国公立大学法人地位的困境溯源与定位分析

摘　　要：我国公立大学存在事业单位属性和法人身份共存的困境。法人定位不明确,造成我国现代大学制度的建设举步维艰,其根源就在于单位制度对大学组织根深蒂固的负面影响,以及我国法人制度建设的不完善。透过单位制度属性困境溯源分析,单位制度本身对大学组织定位就有负面作用;透过法系视角分析,并借鉴典型大陆法系国家和英美法系国家公立大学法人定位的理论与实践,公务法人或公法人中的特别法人对我国公立大学法人重新定位应有所启迪。The state-owned universities in China are not only public institutions but also juridical per- son, which leads to its ambiguous status of corporation and hinders the development of modern uni- versity system. It can be attributed to the adverse impacts imposed by public institutions and the im- perfect legal system. The analysis of these two aspects suggests that the theories and practices of the public university corporation in Continental Law System and Common Law System can be referred to in reorientating the status of legal person of Chinese state-owned universities.
