摘　　要：法律机制包括约束机制和激励机制。通常人们把单位犯罪制度当成一种约束机制,并从约束机制的视角考虑单位犯罪的构成要件,这导致了两个难以解决的理论难题,即单位犯罪的主体范围和客观要件问题。而从激励机制的视角看待单位犯罪的构成要件,即有现实基础和理论依据,更有利于明确单位犯罪的主体范围和客观要件。Legal mechanism including constraint mechanism and incentive mechanism. Usually people use unit crime system as a kind of constraint mechanism, and from the perspective of constraint mechanism, to consider the components of the unit crime, lead to two difficult theoretical problems, which is the scope of the subject of unit crime and the objective requirements. From the view of the incentive mechanism of the components of the unit crime, namely has the realistic foundation and theoretical basis, more conducive to clear the main body of unit crime scope and objective elements.
