民事执行检察监督制度的基本构建

摘　　要：当前"执行难"、"执行乱"的问题在一定程度上打击了当事人的积极性,影响到法律的公信力。欲从根本上破解这一难题,必须将其纳入检察监督的体系中,而检察机关作为我国的法律监督机关,对民事执行案件实行有效监督既有充分的理论基础,又有丰富的实践基础。构建民事执行检察监督制度应从民事执行检察监督的对象、方式、程序等方面进行规范,并从立法上进行完善。At present, the problems of ＂being difficult to execute＂ and ＂executing disorderly＂ hit the enthusiasm of the parties and affect the credibility of laws to a certain extent. To fundamentally solve this problem, it should be in- eluded in the procuratorial supervision system. As a legal supervision organ, procuratorial organs have both sufficient theoretical basis and rich practical foundation in exercising effective supervision to the civil enforcement cases. The procuratorial supervision system of civil enforcement should be constructed from regulating the object, methods, and procedures of prosecutorial supervision of civil enforcement and be improved from legislation.
