我国农业生态环境保护立法探析

摘　　要：在我国农业现代化和社会化推进过程中,生态环境问题十分突出,主要表现为农业资源供需矛盾突出、农业生态环境破坏和农业环境污染问题严重等。法律手段是解决农业生态环境问题的核心,但我国的农业生态环境保护立法明显存在不足,严重制约了其功能的有效发挥。建议制定一部统一的农业生态环境保护综合性法律;填补立法空白;强化环境执法机构的强制性手段,协调相关的利益关系;完善相关的配套性机制和程序机制;严格法律责任;完善执法体制等,以完善农业生态环境保护立法,为农业生态环境保护事业的健康发展提供有力的法律保障。Problems of eco -environment are conspicuous in the process of China~ agricultural modernization, which find expression in the contradictions of supply and demands of agricultural resources, the deterioration and pollution of agricultural eeo - environment. Le- gal means are the key to such problems. But the legislation for the protection of agricultural eeo - environment in China is far from perfeet, which seriously hinders its functions. Thus, it is necessary to enact an efficient law for the protection of agricultural eco - environment, which will improve the existing legal means and institutions, coordinate the interest groups, clarify legal responsibilities and perfect the law enforcement system in order to ensure a powerful legal guarantee for the protection of agrieuhural eco - environment in China.
