摘 要:劳动监察在调整劳资关系的法律机制中扮演着重要角色,承担着劳工权益"底线控制"的国家责任。我国正处于社会转型期,劳资矛盾日益凸现,但劳动监察却未能有效承担相应职责而陷入"权力虚置"状态。国家承担对劳动者基本权利的保障义务,这是西方劳动监察的发展主线,为我国劳动监察的完善提供了借鉴。为突破劳动监察的践行窘境,执法者必须正视"为谁执法,为什么执法"的问题,划清职责边界,并通过建立劳动监察的三方机制,完善参与式执法程序,以此规制监察主体的行为。Labor inspection, playing an important role in adjusting legal mechanism in labor relations, undertakes national re- sponsibility for the "control of bottom line" in labor rights. In our social transition, labor contradictions increasingly occur, while the labor inspection failed to assume corresponding responsibilities, leading to "rights fause" situation. The nation shares the re- sponsibility of safeguarding workers' basic rights, which is the development route of the western labor inspection, providing ideas for the perfection of labor inspection in China. In order to break through the labor inspection practice, law enforcement must know clearly about for whom and why it will be, clarify the responsibility boundary, and perfect the participatory law enforcement pro- cedure through the establishment of labor inspection tripartite mechanism, regulating the supervisors' behaviors.
