公诉案卷移送制度刍议

摘　　要：科学合理的案卷移送制度有利于后续诉讼程序的有效推进,体现出程序正当和保障人权的要求。我国公诉案卷移送制度经历了从全案移送主义到复印件移送主义,再回到全案移送主义的变迁,呈现出我国司法领域不断追求公平和效率的特点。然而,任何制度都不可能完美无瑕,公诉案卷移送制度也不例外。因此,针对新刑事诉讼法中对全案移送主义的回归,探究其回归后的本质属性和可能存在的问题并提出完善建议具有重要的现实意义。Scientific and rational Dossier Transfer system is conducive to the effective progress of human rights. Our Dossier Transfer experienced the transferred from the All Dossier to the Photocopyism,change back to the All Dossier. It reflects that our judicial field continue to pursue the balance between fairness and efficiency. Of course, any system can not be perfect, for the return of the All Dossier this paper tries to analyse the nature of this regression, and puts forward some suggestions in order to play a valuable role.
