摘　　要：在我国的专利许可市场中,主要障碍就是对专利许可费的合理性难以确定。专利许可在专利法中存在的问题有:对专利费用的许可问题不详细,也缺乏灵活性,对其实践性的指导意义不大。实施专利技术许可要有具体的专利许可法规条文,要做到专利双方互惠互利,要完善专利合同法,对"平衡利益"进行细化,并运用到专利的实践中,创建专利典型区与活跃区。In our country＇s patent license market, the main obstacle is that the rationality of patent license fees is difficult to determine. Problems of special licensing in the patent law are： the license of patent fee is not detailed, but also lack of flexibility, the practical significance is not big. The implementation of the patent technology licensing must have specific patent licensing pro- visions in laws and regulations, achieve mutually beneficial to improve the patent law of contract, and refine ＂balance interest＂ , and apply to the patent practice to create the typical and active regions of patents.
