190例司法精神病学鉴定为完全责任能力案例分析

摘　　要：目的 通过对司法精神病学鉴定为完全责任能力案例特点的分析,为司法精神病学鉴定提供实践指导.方法 通过回顾性调查研究,收集福建泉州市第三医院2003年～2012年10年间190例鉴定为完全责任能力者的资料进行分析.结果 190例完全责任能力者均为现实动机作案,被鉴定人多为男性（84.7%）,平均年龄（30.62±10.32）岁,初中及以下受教育程度87.4%,送检单位以公安机关为主95.8%,提出鉴定者以家属居多85.3%;2007年后被鉴定为完全责任能力者比率较之前升高,差异有统计学意义（χ2=5.80,P＜0.05）,其中有完全责任能力无精神病者比率也较2007年之前升高,差异有统计学意义（χ2=4.73,P〈0.05）.结论 司法精神病学鉴定为完全责任能力无精神病者比率有增加的趋势,以男性、受教育程度低者居多.Objective Through analysis on characteristic of cases of forensic psychiatric expertise testimony with full crimi- nal responsibility, providing practical guidance for the forensic psychiatric expertise certification. Methods To review = and ana- lyze 190 cases of forensic psychiatric expertise with full criminal responsibility from 2003 to 2012 in Fujiang Quanzhon the third peopleg hospital . Results The reality motive of the individuals responsible for the crime is applicable to all the 190 cases. Most of the appraised individuals were male. The average age was （ 30.62 ±10.32 ） years old, the percentage of people who accepted middle school or below education were 87.4%. Moreover, inspection unit to the public security organs occupied a very big portion （95.8%）, the majority appraisal were made by families（85.3% ）. Since 2007 the ratio of identified as full responsibility has significantly increased, the ratio difference before 2007 was statistical significant lower （X2 = 5.80, P 〈 0.05 ） , compared with the ratio difference after 2007. It was the same as identifing without mental disease （X2 = 4. 73, P 〈 0.05 ）. Conclusion The rate of full responsibility criminals with no psychosis tend to increase in the appraisement of forensic psychiatry. Most of these criminals were male and with lower educational qualification.
