非法吸收公众存款罪的司法认定——从神木县民间借贷危机谈起

摘　　要：随着去年煤炭价格一路走低,资金链断裂,陕西省神木县爆发了民间借贷危机。危机爆发之后,与此相关的一些犯罪行为浮出水面。由于非法吸收公众存款罪的外延过于模糊和宽泛,导致实践中容易扩大犯罪圈,冲击民间融资的正常和健康发展。因此,只有牢牢抓住该罪的行为特征、后果及主观方面等构成要件,给非法吸收公众存款罪准确定性,才能正确适用刑法,也才能在尽可能的范围内给民间融资一个宽松的生存空间。Because of the coal price reducing last year, the fund chain broke in the financial field, the private money lending crisis happened in Shenmu County in Shaanxi Province. After the outbreak of the crisis, some relat- ed crimes were exposed. The extension of the crime of illegal absorbing public deposits is too vague and broad which causes the expansion of the crime. It badly influences and impacts the normal and healthy development of private financing. Therefore, only in a way to grip elements of the behavioral characteristics, consequences and its subjective elements, can we discern the crime of illegal absorbing public deposits, correctly apply the criminal law, and give a way to private financing.
