《刑法修正案(八)》对重刑犯监狱的影响及对策

摘　　要：根据调查问卷统计的数据,《刑法修正案(八)》对重刑犯监狱有较大影响。一是对重刑犯心理的双重影响,积极影响是增强了刑罚对重刑犯的威慑作用以及重刑犯对刑罚的恐惧心理使重刑犯感到悔恨有利于其接受改造,起到了预防改造倒退的作用;消极影响是重刑犯出现不同程度的消极心理和偏激行为,可能会加重重刑犯的监狱人格。二是对重刑犯监狱的警察产生的双重影响,由于新刑法增强了刑罚的威慑作用而强化了监狱警察对监狱事业的信心,却增加了他们的工作压力以及与罪犯之间沟通的困难。应分别针对重刑犯、监狱警察、监狱机关等制定应对策略。According to survey data and theoretical basis, we summarize and analyze the influence and the counter- measures of Criminal Law Amendment （eight） to the high security prison. One is the dual influences on felons＇psychology, positive effect is to enhance the deterrent of penalty to prisoners and fear of prisoners on penalty; that some prisoners feel regret to accept correction, prevent transformation back effect; negative effect is that some prisoners had different degree of negative psychological and extreme behavior, which may aggravate felons＇ prison personality. Two is the double impact on police of high security prison, since the new criminal law has enhanced the deterrent effect of punishment and the prison police confidence in the prison enterprise, their work pressure and communication difficulties with criminals have increased. Three is the countermeasures includes all aspects of the coping strategies for felons, prison police, prison authorities, and the state.
