摘　　要：特许经营是中国市政公用事业市场化改革的主要制度实施工具,现有立法在市场准入、运营环节、市场退出等诸多方面存在不足之处。强化政府管制固然是完善立法、矫正"撇脂行为"的重要抓手,但竞争机制的完善则是夯实基础的治本之道,尤其是对行政垄断的规制和招投标法律制度的建设,将为持续深入推进中国西部城市公用事业市场化改革进程提供坚实的法治保障。Franchise operation is a tool for the implementation of municipal public utilities in Chinese market reform, but the existing legislation system has many shortcomings. Strengthening regulation is an important means to perfect the legislation, but perfecting the competition mechanism is the root of marketization, especially the construction of administrative monopoly legal reg- ulation and the bidding law. It will provide solid support for the municipal public utilities of China＇s western cities.
