德国一流大学的校长选任制度——柏林洪堡大学的个案分析

摘　　要：柏林洪堡大学的校长选任由不同的机构分工负责:大学理事会负责提名,大学师生员工代表大会负责选举,州政府负责任命。三个机构在此形成有效的分权制衡,以保证可以选出同时得到政府、社会和大学认可的校长。这种校长选任制度既尊重大学的自治权,又保证让政府和社会可以对校长选任施加影响;既保证让大学里的不同群体民主参与,同时又赋予教授群体最大的影响力。洪堡大学校长选任制度的特点反映出德国大学治理结构的特点:政府放权、大学自治、分权制衡、民主参与以及教授治校。The election and appointment of the president of Humboldt University of Berlin are respectively in the charge of different organs. The University Board is responsible for proposing presidential candidate. The Congress consisting of teacher and worker delegates as well as student representatives is responsible for the election. The government of Berlin is responsible for the appointment. Three institutions form an effective separation of powers so as to ensure to elect the president who can get the recognition of the government, the society and the university. This system of presidential election respects the autonomy of the university ,gives the government and society the possibility of exerting certain influence at the same time. It grants all groups the right to the democratic participation,and meanwhile maximizes the professors＇s influence. The characteristics of the presidential election of Humboldt University reflect those of the governance structures of the German university, which include devolution of government power,autonomy of university,separation of powers and democratic participation and professors＇ governing the university.
