摘　　要：在现代大学制度框架下,进一步理解和分析教育法制及其困境是目前高等教育发展的重要问题之一。我国教育法制建设取得了明显成就,高校章程建设取得了实质性的进展。高校教育法制建设和实施面临许多问题。在制定大学章程的实践中,要不断完善教育法制,真正建立现代大学制度、自上而下地去行政化、强调人大立法等,实现高校的科学发展。Under the modern university system ,one of the important issues of the current higher education development is the further understanding and analysis of the legal system of education and its dilemmas. The legal construction of education in China has obtained obvious achievements ,and the regulation construction of colleges and universities has made substantial progress. However ,the legal construction of education and its implementation inevitably face many problems. In the practice of the formulation of regulation ,the legal system of education should be improved by establishing modern university system ,administrating universities from top to bottom and emphasizing the legislation of National People ’s Congress in order to realize the scientific development of universities.
