论我国民事共同诉讼制度的完善途径

摘　　要：共同诉讼制度的设计关系到法律的统一、司法的效益、诉权的保护等价值目标的实现。在新的社会背景下,对于普通共同诉讼,应从明确分类、扩大适用范围、明确追加必要共同诉讼人的时间等方面加以完善;对于必要共同诉讼,应从扩大适用范围、完善使用条件等方面加以完善。此外,法官业务水平的提高和释明权的有效行使,也有利于提升共同诉讼制度在司法实践中的适用效果。The design of joint procedure system is connected with law unity ,judicial effect and the protection of lawsuit right .For com-mon joint litigation ,we shoudl charify its types ,expand applying scope ,make clear the time when to add the litigant in necessary coliti-gation;For necessary colitigation,we should expand applying scope and perfect its applying conditions .More over,the improvement of judge＆#39;s professional level and the effective implementation of inter pretation right can benefit the effect of joint procedure system in judi -cial practice .
