羁押必要性审查制度实施问题研究——基于《人民检察院刑事诉讼规则(试行)》相关规定的思考

摘　　要：新颁布的《人民检察院刑事诉讼规则(试行)》从羁押必要性审查权归属、审查启动方式、审查内容、审查方式、审查效力等方面细化了羁押必要性审查制度,但调研显示,该规则在实施中却遭遇了困境,这种实施困境主要是因为审查人员存在认识偏差、审查内容设置不全面以及审查实施流程、审查期限、审查激励等制度缺位造成的。为此,需进一步明确羁押必要性审查的价值、增补羁押必要性审查内容、设计羁押必要性审查实施流程、增设羁押必要性审查期限等制度,并将"安全变更羁押措施率"作为考核指标。The new （（People＇s Procurator ate Criminal Procedure Rules）） details Detention Censorship regulation from censor owner- ship,start way,censor content,censor method and censor effect.But it shows that such elaborate rules are difficult to implement, which results from censors＂ awareness deviation,comprehensive contents and lacking of implementation procedure,period and incen- tive rules.To promote the practice characters of detention censor regulation,it should advocate value of censoring detention,supple- ment content and period rules of detention censor and design censor procedure.At the same time ,safe changed detention rate should be as evaluation index.
