移植刑法理论需要注意的问题——兼与张明楷教授两个刑法观点商榷

摘　　要：移植刑法理论时,需要考察移植的理论与我国的社会治安、犯罪状况以及国民的道德水平、规则意识等因素是否相适应。从这个角度看,张明楷教授主张我国财产犯罪的保护法益包括财产的占有以及财产性利益属于财产犯罪对象的观点,并不妥当。When the criminal law is transplanted ,we need to consider whether the transplanted theory is adapted to our country’s social security ,criminal situation as well as people’s ethical standards and awareness of rules .From this point of view ,Pro-fessor Zhang Ming-kai’s point of view is inappropriate .He advocated the protection of legal interests of property crimes in Chi-na including the possession of property and property interests belonging to property crime object .
