法益解释机能的司法实现——以污染环境罪的司法判定为线索

摘　　要：法益理论解释机能的实现有赖于刑事司法实践中对个案或类罪的法益判定。法益判定的逻辑过程主要包括法益类型识别、法益位阶度量及法益价值量确定。法益类型识别是法益解释机能司法实现的逻辑起点、法益位阶度量是法益解释机能司法实现的价值依据、法益价值量度量是法益解释机能司法实现的技术路线。污染环境罪所侵害的实质客体包括生态法益与秩序法益,其中生态法益是该罪侵害的核心实质客体,也是该罪司法判定过程中法益识别与度量的主要对象。人的生态法益是污染环境罪法益位阶度量的首要标准,但在生态文明理念下,其它主体的生态法益也应作为度量标准。生态法益价值量的判定需与人身法益、财产法益进行转化,并应以生态价值评估方法科学确定生态价值的损害程度。The implementation of the explanation function of legal interests theory in Criminal Law relies on the legal interest determination of individual cases or case classes in criminal justice practices. The logical process of the determination of legal interests includes identifying types of legal interest, measuring legal inter- est levels and determining legal interest values. Identifying types of legal interests is the logical starting point, measuring legal interest levels is the value basis for the judicial implementation of the explanation function of le- gal interest theory and determining legal interest values is the technical approach for the implementation. The substance of the object in Environmental pollution offense includes ecological legal interests and order legal in- terests and ecological legal interests is the core and object of identifying and determining legal interest in crimi- nal justice practice. The people＇ s ecological legal interests are the first standard in determining the legal inter- est in environmental pollution crimes, while the ecological legal interests of other subjects shall also be taken into account under the principle of ecological civilizaton. The determination of ecological legal interests shall be translated into personal and property legal interests and the measure of the magnitude of ecological legal inter- ests requires scientific approach.
