摘　　要：技术研发、转移、推广应用中良性和稳定的社会关系,是影响技术创新成效的重要因素。技术争端对技术创新社会关系有干扰和破坏作用,司法活动要突破"只问是非"的局限,基于提供优质司法公共服务之目的,通过裁判、协调、支持等手段尽力修复技术创新社会关系,相关司法改革应当从观念、体制等方面提高修复技术创新社会关系的能力。A benign and stable relationship is a very important factor that can affect the result of technical innovation during research,transform,application and dissemination of technology.Technical dispute have a disturbing and destructive effect on social relationships about technical innovation.Judicial activities need to break through the limit of ＂yes or no only＂ to repair social relationships.Based on purpose of offering high quality judicial public service,judicature should use all the ways to repair social relationships about technical innovation by judgment,coordination and support.Related judicial reform should improve judicial capacity of repair social relationships about technical innovation in field of concept,system and so on.
