市场结构变化下中间品区别定价的反垄断经济学分析

摘　　要：我国《反垄断法》和《反价格垄断规定》都对市场中的区别定价行为进行了规制。但从法律条文的表述中不难发现,这些规定比较笼统,既没有区分最终产品市场和中间品市场,也没有考虑到不同市场结构下定价均衡的变化及其对社会总福利的影响。本文从反垄断经济学的角度,对不同市场结构下纵向产业链中中间品不同定价方式的均衡进行了分析,并根据理论分析对中间品区别定价的影响加以细分,以期对相应的法律条款加以细化,为规制机构合理规制相关产业提供了一定的理论依据。There exist some legal terms on price discrimination in both “Anti--Monopoly Law” and “Provisions on anti price monopoly” in China. However, it is not difficult to find out these pro- visions are general. Neither do they differentiate the final product market from the intermediate goods market, nor take the changes in equilibrium price under different market structure and its im- pact on social welfare into account. This article analyzes the pricing equilibrium in input market un- der different market structure from an economic point of view, subdivides the impact according to the theoretical analysis, in order to refine the corresponding legal provisions and provide a reasona ble theoretical basis for regulatory agencies.
