摘 要:中国现行法律规定,刑事审判监督程序的提起主体是终审法院的院长、终审法院的上级人民法院和终审法院的上级人民检察院。这不利于保障被告人的权利。应当对人民法院提起审判监督的权力进行改革,即将审判监督程序启动权收归上级人民法院和最高人民法院,而且要区分有利于被告人的再审和不利于被告人的再审。人民检察院的抗诉权对于有利于被告人的再审和不利于被告人的再审应该区别对待。The filed subject of criminal retrial procedure in our current law is the director of the court of final appeal, the superior people's court of final appeal and the next higher level people's procuratorate of the court of final appeal. This is not conducive to safeguard the rights of the defendant. Reform ought to be made in the power of the people's court judicial supervision. The procedure for trial supervision started back to the superior people's court and the supreme people's court, and to distinguish the retrial in favour of the defendant and the retrial against the defendant. The right of the people's procuratorate to protest the defendants'retrial and against the defendants'retrial should be treated differently.
