研究生学位授予中学位申请人的救济机制研究——以对学位论文的学术评价为中心  

On the Applicant's Remedial Mechanism in the Course of Graduate Degree Awarding——Focusing on the Academic Evaluation to the Dissertation

摘　　要：研究生学位授予关涉学位申请人的重大利益,对学位论文的不当学术评价而引发的不利,应当为申请人从制度上提供救济措施。如果申请人对论文评阅人的否定性结论持有异议,可以申请组建专家委员会进行审议;答辩委员会对学位论文的品质所做出的评价为终局决定,申请人不得对此提出异议;学位评定分委员会、学位委员会在审核时,不得因学位论文的质量问题而拒绝授予学位。学位论文学术评价权的归属,成为界定相关主体行为边界的主要决定因素。The graduate degree awarding is very important to the applicant, so he or she should be provided with remedies from the legal system if suffering damages from the wrong academic evaluation to dissertation. If the applicant disagrees with the dissertation reviewers＂ negative conclusion, he or she can apply for forming an expert committee to re-review. The evaluation of the Academic Defense Committee to the dissertation quality is a final decision, and the applicant shall not raise an objection. Academic Degree Evaluation Subcommittee and Academic Degree Evaluation Committee of the university shall not refuse to award degrees due to the quality problem of the dissertation when they audit and decide whether awarding degrees. The ownership of the academic evaluation right is a major determinant to define behavior boundaries of the relevant subjects.
