摘 要:我国行政法的实施受困于其"路径依赖",这种"路径依赖"主要体现为"行政机关中心主义"。行政机关不仅是行政调控法的实施主体,而且在行政救济法的实施中扮演重要角色。此种"路径依赖"阻隔了行政调控法与救济法的互动,使得司法权对行政权的监督以及对公民权利的保护处于不确定性状态。要实现行政法的有效实施,须从制度结构入手破除此种"路径依赖",实现行政审判的独立性,在国家治理的框架下再塑行政诉讼构造。The implementation of the administrative law of our country is trapped in its "path dependence", which is mainly reflected as " executive centralism". The administrative organ is not only the principle implementing executive of the administrative control law, but also play an important role in implementing administrative remedy law. The " path dependence" blocks the interaction between the administrative control law and the administrative remedy law, which makes the the judicial supervision of administrative power and the protection of the rights of citizens under the uncertain condition. To realize the effective implementation of administrative law, we must start from the system structure and get rid of such " path dependence" so that to realize the independence of administrative trial and remodel the administrative litigation structure under the framework of national governance.
