摘　　要：随着城市使用民族语言的少数民族流动人口持续增加,当事人使用本民族语言文字进入诉讼程序的法律案件不断增多,且呈持续增加的趋势。司法机关因司法资源有限,各方面准备不足,影响了《宪法》及其他法律关于保障少数民族流动人口使用本民族语言文字进行诉讼,这一权利在侦查、检察和审判的过程中的严格实施,并存在制度的、结构的和法律技术的严重缺陷。着力解决当前缺少国家通用语言与少数民族语言的双语法律人才、少数民族法律翻译职业化不足、少数民族法律翻译用语统一标准难等问题,亟待从制度、程序和组织上,完善少数民族语言法律翻译、法律双语人才引入机制、法律翻译职业化的政策法律,建立起双语法律人才库的培养机制,统一少数民族语言文字诉讼法律翻译标准。With the continuing increasing population of ethnic minority migrants speaking in their native languages in urban cities, cases litigated in ethnic minority＇ s nahve languages increase as well. The limited judicial resources in the hand of the Judiciary, lack of preparation in all aspects bring a negative influence to the right to litigating in ethnic minority languages guaranteed by Constitution, Criminal Litigation Procedure Law, Civil Litigation Procedure Law and Administrative Litigation Procedure Law in the process of investigation, prosecution and trial process and there are serious institutional, structural and legal technology seriously defects. In order to resolve the current lack of bilingual legal interpreters fluent at both national common language and ethnic minority native language, low level of professional interpretation of ethnic minority native languages and nonexistence of interpretation standard of ethnic minority native languages, it is necessary to perfect mechanisms of ethnic minority native languages legal interpretation, cultivation of legal bilingual interpreters and policies of professionalization of legal interpretation, establishing a training mechanism for bilingual legal interpreters and unifying standards of interpretation of ethnic minority native language in litigation.
