摘　　要：构建跨流域调水生态补偿法律制度,是协调调水沿线各方利益关系、推进生态文明建设的制度保障。本文从分析我国跨流域调水生态补偿的特征出发,探讨了跨流域调水生态补偿政策法规进展,分析了跨流域调水生态补偿法律制度存在的问题,进而阐明市场经济条件下构建跨流域调水生态补偿法律制度的设想,并从补偿主体和受偿主体、生态补偿标准以及制度和机制建设方面明确了我国跨流域调水生态补偿法律制度建设的具体措施。The construction of the inter-basin water transfer ecological compensation legal system is to coordinate the various interests involved along the route and promote the ecological civilization construction system of protection. By analyzing the characteristics of the inter-basin water transfer ecological compensation, this paper discusses the progress in the policies and regulations for the inter-basin water transfer ecological compensation, points out the problems in the law system for the inter-basin water transfer ecological compensation, and thus clarifies the idea of building the inter-basin water transfer ecological compensation legal system under the market conditions. By clarifying the aspects of compensation body and repayment body,ecological compensation standards and the building of systems and mechanisms, the paper demonstrates the specific measures for the construction of China＇s inter-basin water transfer ecological compensation legal system.
