中国大学章程内容的缘法与求新

摘　　要：中国大学章程制定已经进入新阶段。在建设法治国家的背景下,大学章程既要严格按照法律规范将法定内容详加规定,又须结合大学实际情况进行特殊考虑,使大学章程具备合法性和可行性。同时,紧密围绕大学治理结构和大学成员地位两大重点,对大学的权力进行合理配置,对成员的权利进行切实保障。在此基础上构筑大学章程内容的全景,以实现大学章程内容的缘法与求新。A new stage has come to establish the Articles of Chinese Higher Learning Institutions. Under the circumstances of building a law-based state, articles of higher learning institutions should not only scrutinize legiti- mate contents strictly by legal criteria, but take into special consideration the reality of higher learning institutions so as to be lawful and operable. Meanwhile, considering the administrative structure and the status of college facul- ty, they should properly allocate institutional power and practically assure the right of college faculty. Based on the above-mentioned considerations, we can hope to establish a wholesome view of the Articles of Chinese Higher Learning Institutions to realize innovations by carrying on established practices.
