摘 要:2012年《民事诉讼法》对国内仲裁裁决不予执行情形作出的修改成为一大亮点。长年以来,我国法院在不予执行程序的规定下,区别对待国内仲裁裁决,对其享有极大范围的实体审查权,从而使得一裁终局制度形同虚设。在新民诉法出台后,这一局面将有所改善,但是也远未能达到一劳永逸的效果。因此,我国应当从立法和司法两个层面上继续推动对不予执行程序的修改和完善,才能真正保障仲裁制度的健康发展。For a long period of time, the Chinese court under the previous non-enforcement procedure, it has distinct treatment against domestic arbitration awards and international arbitration awards, in treating the domestic arbitration awards, the Chinese court retain powers in reviewing the merits of the awards, including mistake of law and facts. Although the new 2012 Chinese Civil Procedure Law had progressed in this area, however it still doesn't solve the substantive issue. Therefore, China should keep improving the non-enforcement procedure until completion, by its legislative and judicial power.
