专利消极引用视角下的企业技术竞争研究

摘　　要：对专利引用的法理背景、专利申请方的引用目的、专利审核员对专利引用的审查过程进行系统分析,发现专利引用的主要目的是消极引用。吸收创造性破坏理论与动态竞争理论的思想,指出专利消极引用实质上是施引专利对被引专利的技术优势与市场竞争力的双重破坏。在此基础上,提出基于专利直接引用的企业技术竞争模式的研究思路,并对该研究方法的立论基础、具体流程和分析方法进行了讨论。This paper systematically analyzes the legal background of patent citation, the purpose of citation of patent appli- cants, and the examined process of patent citation by patent examiner, and finds that the main purpose of patent citation is negative citation. By absorbing thoughts of creative destruction theory and dynamic competition theory, the paper points out that patent nega- tive citation is essentially a double damage on both technical advantage and market competitiveness of cited patent by citing pa- tent. On this basis, the paper proposes the research thoughts of enterprise technical competition model based on patent direct cita- tion, and discusses the theoretical basis, specific process and analysis method of this research method.
