摘 要:先秦儒家推行的礼是社会成员共同遵守的行为准则和行为模式。礼治是通过等级礼仪制度、政治运行规范、社会生活原则来建立和维护社会秩序。礼治秩序是儒家建构理想政治秩序的核心元素,也是儒家治理社会的目标,其内容及合法性思想主要包括:君民有别,等差有序;情欲难免,节欲礼控;礼本法末,德主刑辅;礼乐之统,以乐从仁。在社会转型的今天,我们面临着政治体制的改革和挑战,"吸收"、"转化"礼治秩序思想和经验,对当代政治秩序化建构有着举足重轻的借鉴意义。The pre Qin Confucian ritual is the model code of conduct and behavior that all of soeial members should be abided. Etiquette is an social order, which is established and maintained by the system of rank, the standardized of prolitrcal operation and political social life principles. Rite order is the core element for Confucians to construct its political order, and social goal of its management, its content and legal thought mainly include: The emperor and the people of different grades, arithmetic and order; lust unavoidably, ritual control of desire;The ritual and virtne are primary, the law and punishment are the supplement; ritual combine with music, ritual music contains the spirit of benevolence. In today's social transformation, we are faced with the challenge and reform of the political system,and how to "absorb","transform" rite order thought and experience is of vital significance on the construction of political order.
