摘　　要：犯罪污损了刑法所保护的法益,导致某种社会关系的断裂。欲修复有序和谐的社会关系,须架构良性运行的治理模式。犯罪综合治理是我国的基本模式,但对甘青藏等民族地区的犯罪治理,在制度安排上应高度考量当地实情,遵从刑事法律谦抑原则,秉持法律多元主义立场,彰显刑事法的实质理性,改造和调适诸如刑事习惯法、乡约村规等具有"地方性知识"的解纷资源,通过适度变通刑事法律、分区治理、积极展开犯罪预防、制定并实施公平详备的社会政策以及有效整合社会资本等途径,均衡各方主体利益,形塑符合本土需求和民众认同的压力疏导型治理模式。Crime will destroy the legal interest from criminal law and result in the disruption of certain social relationship.To restore an orderly and harmonious relationship,it is necessary to construct a well-operating crime control mode.The comprehensive crime control is Chinese basic mode,but for the crime control in the minority areas of Gansu,Qinghai and Tibet,some measures about the system arrangement should be taken as follows：to examine and weigh the local situation seriously;to comply with the modestly restraining principle of criminal law;to uphold the pluralism of law;to demonstrate essential rationality of criminal law;to remold and adj ust the resources of dispute resolution with local knowledge like criminal customary law and country regulation. Through appropriate adaptation of criminal law,regional management,active prevention of crime, impartial and detailed social policy’s formulation and implementation and effective social capital’s integration,all subj ects’interests is to be balanced and the mode of crime control,which can meet the local requirements,disperse the pressure and the common people can identify with,is to be created.
