果洛地区建立健全民事习惯法司法适用机制的思考

摘　　要：果洛藏族民事习惯法被当地民众极大程度地接受和需求,但同时也受国家制定法的影响,这使得该地区的司法秩序出现了相应的混乱现象,解决这一问题,不仅需要认识到习惯法的存在价值,更需要建立健全使用机制,以正当的程序实现其应有的价值。The tibetan civil customary law in golog prefecture is widely accepted and needed by local people while influenced by the national legislation,which had led to a relatively messy situation for the local judicial proce- dure. To solve this problem,it requires not only awareness of the value of civil customary law, but also establish- ment of a mature operation system;thus the due value of civil customary law could be achieved.
