摘　　要：针对近期不同省、市、地区的司法鉴定机构、人民法院在对新生儿手足缺如引发的医疗纠纷案件依法进行鉴定、审理的过程中,存在着不同的观点与处理方式,并随之产生不同的甚至大相径庭的处理结果的情况,本研究对此类案件的特点、性质、分类及医疗机构的应对方式等相关法律问题进行分析,倡导理性对待、妥善解决此类案件,从而维护医患双方合法利益,促进医患间的相互理解与和谐医患关系的建立.A variety of views and approaches were found in the appraisal and judgments of the people＆#39;s courts in various provinces and cities,on medical disputes involving absence of a hand or foot of newborns,which result in different or event contradictory court decisions.This study made an analysis of the characteristics,nature,and classification of such cases as well as countermeasures of medical institutions,with recommendations on rational and appropriate handling of such cases,for the purposes of legitimate rights maintenance of both doctors and patients,and promotion of mutual understanding between the two parities,and establishment of a harmonious doctor-patient relationship.
