司法如何回应网络技术进步——兼论视听传输技术作证的运用规则

摘　　要：视听传输技术作证方式的适用现状,反映出相应技术手段与司法程序尚未达到相互理解的和谐状态,司法面临如何回应网络技术进步的问题。司法与技术的关系从分立走向耦合,促进了两者的互动和理解。视听传输技术作证与直接言词原则存在一定的冲突,但作为解决证人出庭困难的特殊作证手段之本质,并且通过网络技术与直接言词原则的调适,使其正当性得以充实。对视听传输技术作证不论是持积极还是消极的态度,都不是问题的实质,明确该作证手段的理念和运用规则才是司法回应网络技术进步的有效方法。在适用视听传输技术作证方式时,应坚持有限利用、当事人选择、诉讼辅导、交叉互补等规则,以突出普通作证手段之补充的地位,追求该作证手段应用的适度性。The applicable status of audio-visual transmission technology reflecting the technical means and the judicial process has not reached harmony state of mutual understanding. The problem that judicature face is how to respond to the network technology advances. The relationship between justice and technology changed form discrete to coupling, promoting the interaction and understanding of justice and technology. There are certain conflicts of audio-visual transmission technology and the principle of direct testimony. But the essence of audio-visual transmission technology is a special solution to the witness difficult to appear in court to testify.The adjustment of network technology and the principle of direct testimony can enrich the legitimacy of audiovisual transmission technology. The essence of the problem is not whether positive or negative attitude towards audiorvisual transmission technology. The effective method of judicature responds to network technological advance is making clear the concept and applicable rules of audio-visual transmission technology. In the application of audio-visual transmission technology for testimony, we should insist on the rules of limited use, the parties＇ choice, procedure guidance, cross complementary and so on. ~We should stress audio-visual transmission technology＇ s additional position of common testimony ways and pursue the moderation of audio-visual transmission technology.
