试论正当防卫

摘　　要：正当防卫制度古来有之 ,但与现代刑法的规定相比 ,防卫的对象、条件和对于正当防卫的限制均不相同。我国新刑法对于正当防卫的规定 ,可以说是基本上建立了一种“无限防卫权”制度 ,这对于打击犯罪、保护人民生命健康和财产权利必将起到积极的作用。但其中关于对“行凶”者可以进行正当防卫的规定是否科学 ,值得商榷。所以 。The system of legal defense has been existing from ancient times.However,compared with current criminal law's regulations,the objects,conditions and limitations of legal defense are different.The regulations on legal defense in our new criminal law,you may say,foundamentaly establishes a system of “right of boundless defense”.It will surely play an active role in cracking down on criminal activities.and in protecting people's life,health and property right.But it deserves furthur discussion on the regulations that we can make legal defense against “the perpetrator”.Therefore,it is neccessary for us to make furthur research on the legal defense system regulated by the new criminal law.
