摘　　要：绿色产业因具有正外部性与公益性,其专利池的构建目标、模式选择、运行机制及反垄断审查等方面与其他产业专利池有一定差异。基于外部性与公益性的视角提出绿色产业专利池的构建与发展目标,探讨其运行机制中存在的问题及解决策略,剖析绿色产业专利池的滥用与反垄断审查内容,以推动我国绿色产业专利池的健康发展。Because of its positive externality and public welfare, the construction goal, mode selection, operational mechanism and antitrust review of patent pool of green industry will be different from those of other industries. From the perspective of externalities and public welfare, the paper proposes the construction and development goal of patent pool of green industry, and discusses the problem and strategy of its running mechanism, and then analyses the abuse and anti - monopoly review content of green industry patent pool, so as to promote healthy development of the patent pool of green industry in china.
