摘　　要：刑诉法关于保障人权的规定使侦查讯问面临新的挑战,而在长期侦查实践中形成的若干老问题也会从不同方面阻碍保障人权法律规定的落实。在这一形势下,侦查讯问中面临着影响办案的困难因素,既包括保障人权法律带来的新问题,也有侦查讯问自身存在的问题以及基础条件、保障条件及监督等方面的老问题。为了实现"打击犯罪"与"保障人权"的平衡,侦查讯问应当与时俱进,提出有针对性的解决对策。Tile investigate interrogation is facing with new challenges according to the regulations of protecting human rights in criminal law, and some old problems from the long-term investigation practice will hinder the implementation of the safeguard human rights law in different aspects. In this situation, the investigation interrogation will face with tough elements including new problems brought by the protecting hmnan rights law, some existing problems and old problems such as basic conditions, guarantee conditions and supervision, etc. We must keep pace with the times, and find out targeted countermeasures to achieve the balance between the “combating crime” and the “protecting human rights”.
