摘 要:农村房屋抵押权实现的法律障碍在于:当前的法学理论与实践不当地将"地随房走,房随地走"(即"房地一致")原则适用于农村房屋抵押实现场合。依现行法,房地一致原则有其固定的适用范围,而且在禁止宅基地抵押的现有规定下,坚持该原则会导致禁止农村房屋抵押的错误结论。因此,只有真正贯彻农村房屋与宅基地处分的分离原则,房屋抵押权实现所致房屋所有权的移转才不会导致宅基地使用权的移转。但此时我国法律需引入推定租赁合同制度来解决房屋新所有人对宅基地的权利基础问题。The main legal barriers in the realization of the rural premise mortgage is the conflict between the identity and welfare of the homestead land use right which is a usufructuary right based on the collective land ownership and the freedom of the ownership of premise built on its site.If the law of China currently abandons the principle of premise legally attached to its sites and separates the premises from their sites on some level,the ownership of the premise should be protected under the rule which forbids the mortgage of homestead land according to Chinese Property Law.On that basis,during the realization of the rural premise mortgage,constructive lease contracts should be applied to give the right base of the premise when realizing the rural premise mortgage since the homestead land use right is not transferred along with its premise ownership.
