摘 要:宅基地使用权的用益物权性质以及基本特征确定了物权功能的主导地位。但鉴于中国社会的现实情况,宅基地使用权的生存保障功能仍应存在。中国宅基地使用权取得规范的制度变迁呈现出逐渐与社会现实脱节的特点。宅基地使用权的初始取得主体包括一般主体和特殊主体,出让金的缴纳应当不同,行政审批应当坚持,权利救济程序应当完善。宅基地使用权的继受取得应当市场化,但还是应受到优先购买权、权利期限、权利登记等具体限制。The primary function of the use fight of the house site should be exerted as a property right because of its basic characteristic and the nature of usufructuary right. However, according to China's realities, its function of living guarantee should be preserved. The institutional development of the acquisition system of the use fight of the house site gradually comes apart China's social reality. On one hand, the subject of the original acquisition system of the use fight of the house site can be divided into two types, general subject and particular subject. In this regard, there's a necessity to differ the land transaction fees, insist on administrative examination and approval, and perfect relief procedure of rights. On the other, the derivative acquisition of the use right of the house site needs a market reform as well as be bound by preemption, fight time limitations, and the right registration.
