民事诉讼行为能力评定量表信度与效度检验

摘　　要：目的检验自编民事诉讼行为能力评定量表（the capacity assessment scale of civil lawsuit，CASCL）的信度与效度。方法在司法鉴定机构，对评定民事诉讼行为能力的116例案例使用CASCL并采用盲法进行回顾性评分，并与司法精神病学专家出具的鉴定结果进行比较，以检验该量表的信度与效度。结果受试者工作特征曲线（receiver operator characteristic curve，ROC）分析结果示，量表取12分为划界分时，具有较高水平的灵敏度（0．808）、特异度（0．842）、阳性预测值（0．921）和阴性预测值（0．949）。CASCL所有条目Cronbach＇s α系数为0．940；评分者信度组内相关系数（intraclass correlation coefficient，ICC）为0．938（P〈0．01）；重测信度／CC为0．934（P〈0．01）。CASCL各条目与总分的Spearman关联系数为0．531～0．681（P〈0．01）；因子分析结构效度，提取辨认能力、控制能力2个因子，其累积贡献率为75．3％；与鉴定结果进行一致性检验，Kappa值为0．864。结论CASCL具有较好的信度与效度，能较为准确地反映民事诉讼行为能力，对民事诉讼行为能力的评定和划分有无诉讼能力有较好的参考价值。Objective To explore the reliability and validity of self-made ＂the capacity assessment scale of civil lawsuit （CASCL）＂. Methods One hundred sixteen cases were retrospectively assessed by CASCL in the judicial authentication institutions. Comparison between the CASCL evaluation and identification of experts was conducted in order to estimate the reliability and the validity of CASCL. Results The best threshold point analyzed by receiver operating characteristic curve （ROC） was 12, with the sensitivity of 0.808, the specificity of 0.842, the positive predictive value of 0.921 and the negative predictive value of 0.949. The Cronbach＇ s alpha coefficient of items in CASCL was 0.940. The intraclass correlation coefficient （ICC） of interrater reliability was 0.938 （P〈0.01）. The ICC of retest reliability was 0.934 （P〈0.01）. The Spearman correlation coefficients between each items and total score were 0.531-0.681 （all P〈0.01）. Two factors extracted by factor analysis were identify ability and ability to control, respectively. The cumulative contribution rate was 75.3%. The Kappa value was 0.864 in comparison to the identification of experts. Conclusions The CASCL can precisely assess the legal capacity and thus may serve as a good reference to judge whether or not the client has the legal capacity.
