摘 要:当前我国未决羁押者的劳动权保护状况整体上不容乐观:劳动自愿性未得到充分保障;职业选择权行使不充分;劳动项目仅限于简单的手工活;安全事故偶有发生;超时劳动和超强度劳动现象存在;职业技术培训匮乏;劳动报酬比例很低;看守所对劳动收益的使用不够规范和公开。观念、立法和经费的不到位是其三大致因。为此,应采取有针对性的解决措施,提升未决羁押者的劳动权保护水平。The current situation of protection of labor rights for pending detainees in China allows no room for optimism : the voluntary nature of labor is not adequately protected; exercise of option in choosing jobs is not fully granted. Labor is limited to simple handiwork. Safety accidents are occasionally reported. Overtime labor and over-strenuous labor still exists. Vocational and technical training is in short supply. Labor is underpaid. Distribution of labor revenue at detention center is not standardized and transparent. The three causes for such situation are concept, legislation and funding. Therefore, case-specific measures should be taken to strengthen protection of labor rights for pending detainees.
