摘　　要：目前,我国的宪法和法律并没有明确规定关于国际海事公约与国内法的冲突规范,对于国际海事公约和国内法的适用也没有明确的法律规定。我国在缔结或者参加国际海事公约时,应当考虑我国的立法状况,在缔结或者参加公约后,采取必要的措施,坚持预防为主的原则,合理解决国际法和国内法适用的矛盾,尽量避免国际海事公约与我国国内法的冲突。Currently, China＇s Constitution and legislative system don＇t have clear provisions on the conflict rules of international maritime conventions and domestic laws, also applicable of international maritime conventions and domestic laws. If China concludes or attends international maritime conventions, we should take the situation of our country＇s legislation into consideration. After concluding or attending international maritime conventions, necessary measures should be taken in order to resolve the conflict between international law and domestic law reasonably.
