摘　　要：诬告陷害罪侵害的客体是公民的名誉权而不是公民的其他人身权利与司法机关的正常活动；行为人捏造的不需是犯罪事实；向谁告发也不是成立本罪的关键问题；本罪是属于与行为犯、结果犯并列的情节犯。The object offended by this crime is citizens' reputation rights, but not the other personal rights and normal activities of judicial administrative bureaus. It's dispensable for the actor to fabricate criminal facts and whom the actor reports to can' t be the key to constitution of the crime. This crime belongs to circumstances offense on an equality with act offense and consequential offense.
