宪法学理论体系的反思与重构

摘　　要：宪法学的基本矛盾是公民权利与国家权力的关系。其道德基础在于人权保障 ,社会基础在于国家与社会的二元化 ,逻辑起点在于人民主权。完整的宪法学理论体系应以解决这个基本矛盾为主线 ,包括宪法基础、公民权利、国家权力和宪政运行四个方面的内容。This paper, after exploring the moral base, the social base, the logic jumping-off point and the basic contradiction about constitution, puts forward that the basic train of thoughts about constructing constitutional system info should regard the relations between the citizen's rights and the state's power as its main thread, thereout concludes that constitutional system info should comprise 4 basic component parts which are the base of constitution, the citizen's rights, the state's power and the run of constitutional government.
