支持企业改制与维护金融债权的兼容性思考

摘　　要：国企在改制过程中逃废银行债务问题是社会普遍关心的难题 ,本文从理论上论证了支持企业改制与维护金融债权的统一性 ,并从经济学角度对企业改制逃废债行为进行了分析 ,认为逃废债是企业产权明晰化内在要求的必然体现 ,是企业权衡改制成本与收益后作出的一种利己选择 ,也是企业、银行、地方政府与中央政府多方博弈的结果。为此提出了实现二者兼容性的对策与思路。It is a serious problem that state-owned enterprises evade liabilities of banks in the structure reform. Theoretically the paper expounds and proves the unity between supporting the reform of enterprise and defending credit's rights of bank. From the points of view of economics the author analyze the means the enterprises apply in the evasion of financial debts in the reform. Firstly,the enterprise has to evade the liabilitie in order to make property rights clear. Secondly, the enterprise makes a useful choice for itself after it compares cost and income of the reform. Thirdly,it is a result of game that the enterprise,the bank and the government do each other. Lastly,the author put forward suggestions and ideas.
