摘　　要：证券内幕交易是证券市场中极易发生、危害最大、后果最严重的一种违法行为。泄露内幕信息罪的主观方面只能由故意构成 ,不能由过失推导。该罪认定要注意划清内幕交易行为罪与非罪的界限 。Insider trading is a kind of security crimes which easily takes place in the bond market and causes most serious damages and effects.Attention should be paid to the division between insider trading crimes and innocence as well as the differences between insider trading crimes and the crime divulging inside information and the one of letting out a state's secrets.
