神判之“理”——以清水江流域为中心的考察

摘  要:神明裁判活动在清水江流域被视为"天理",意谓是非的裁决乃是上天依"理"而作出,因此具有至高的神圣性。一方面,神判能有效地平息纠纷、稳定秩序、整合族群,显现出"理性"的特征。另一方面,神判多是采取极端方式,折磨当事人身心,借以观察神明意志,具有极大的偶然性,蕴含着"非理性"的因素。"理性"与"非理性"的二元对立,表明"天理"并非神圣永恒的自然法则,而只能是源于"生活世界"的建构。People living in the Qingshui River Basins think of the trial by ordeals as the "heavenly principle", that means that the trial has the supreme sacredness because they believe its judgment is made according to the natural"Reason". On the one hand, the trial by ordeals could effectively settle disputes, stabilize the order and integrate groups which show its "Rationality " characteristics. On the other hand, most of the trial by ordeals would indicate the will by harshly torturing the body and mind of the parties, so the results are of great contingency which show its factors of "Irrationality". The binary opposition between Rationality and Irrationality illustrates that the "heavenly principle"is not the divine and eternal laws of nature but the constructions which originate from the living world.
