摘  要:司法介入高校学生管理行为的范围和限度争论已久,该研究对于司法实务与学术理论意义重大。从行政法理论而言,高校是"准行政主体"、高校管理行为属于"准行政行为"、高校管理过程中与学生形成"特殊行政法律关系",基于此三条原因,此类行为可以纳入行政案件管辖范围。具体而言,凡可能侵害学生受教育权或其他宪法基本权利之行为皆应纳入司法管辖,以利于学生基本权利之保护。凡是纯粹纪律性处罚、考试成绩评定、高校内部必要生活管理行为不应纳入司法管辖范围,以利于高校自主权之维护。理论界、法院指导性案例对于该问题已有深入涉及,时机成熟时宜以法律明定之。It is highly debated that the scope and limit of college students in judical intervention supplying properly for a long time and the research is of graet significance in judical practice and academic theory.From the perspective of Administrative law theory, colleges are quasi-administrative subject and the management behaviors are quasi-administrative behaviors;thus,the process of colleges management formed students with a special administrative legal relationship.For these three reasons,the behaviors can .be incorporated into the scope of administrative legal cases.Specifically,it should be included in the jurisdictions of administrative legal cases that may infringe educational and constitutional rights.More,all disciplinary punishments,assessments of tests and necessary management behaviors should not be included into the jurisdictions in order to maintain the autonomy of colleges.Last,the legislation should be clearly defined in time with the theoretical and judical cases that have been deeply involved in the isssue.
