摘 要:目前,我国农村宅基地制度仍面临管理失序、财产属性缺失、法律规范落后等诸多问题。为解决上述问题,我国将试点宅基地所有权、资格权、使用权"三权分置"。因此,法律应明确规定三权之权利主体、内容及相互关系,尤其是宅基地资格权,因其是首次提出,所以其性质和内容以及与其他权利的相互关系都不甚明确,而宅基地资格权的准确界定对于保护农户权益、实现宅基地财产属性具有重要价值。本文认为,宅基地资格权的法律属性应当界定为"类所有权",并以此为基础进行制度构建。明确宅基地资格权的类所有权属性,有利于厘清相关主体之间的权利义务关系,亦有利于推动宅基地"三权分置"改革的顺利进行。China’s rural homestead system is facing many problems,such as disorder of management,lack of property attributes,backward legal norms and so on.In order to solve the above problems,China will separate the ownership,qualification and use rights of pilot residential land.Therefore,the law should clearly stipulate the subject,content and relationship of the three rights,especially the right of housing land qualification,because it is the first time,its nature and content and the relationship with other rights are not clear,and the accurate definition of the right of housing land qualification is of great value for protecting the rights and interests of farmers and realizing the property attribute of housing land.This paper holds that the legal attribute of the qualification right of homestead should be defined as "class ownership" and the system construction should be based on it.It is beneficial to clarify the relationship of rights and obligations between the relevant subjects and to promote the smooth progress of the reform of "separation of three powers" of homestead by clarifying the category ownership attributes of the qualification right of homestead.
