摘　　要：现阶段,"两童"群体的总体状况不容乐观,"两童"问题本身产生的现实的、潜在的社会危害比较严重,"两童"的社会治理、刑事政策以及相关法律保护等方面还存在诸多问题。在"两童"的社会治理实践中,应成立儿童专门保护机构,并积极引导和发展服务于"两童"的社会公益组织;在刑事政策制定上,要将"两童"的保护、犯罪预防和社会治理效果纳入各级党委、政府绩效考核评价体系;在立法保护层面,要尽快完善现行儿童保护法律法规,建成我国儿童保护的法律体系;在司法适用中,要逐步健全符合未成年人身心特点的司法制度,建立对具有不良行为倾向的未成年人的早期干预机制,大力发展专业社会服务机构,独立设置适合未成年人的惩戒措施体系。Today,the overall situation of the "left-behind and floating children"group is not optimistic, the actual and potential social harm is serious.There are still many problems in social governance,criminal policy and related legal protection.In the social governance practice,special protection institutions for children should be established,and social welfare organizations serving the left-behind and floating children should be actively guided and developed.In the formulation of criminal policies,the protection,crime prevention and social governance should be incorporated into the performance appraisal and evaluation system of party committees and governments.At the level of legislative protection,it is necessary to improve the current laws and regulations on child protection as soon as possible,and to establish a legal system for child protection.In the application of justice,it is necessary to gradually improve the compliance with minors.In the application of the judiciary,it is necessary to gradually improve the judicial system that conforms to the physical and mental characteristics of minors,establish an early intervention mechanism for minors with a bad behavior tendency,vigorously develop professional social service institutions,and independently set up a system of disciplinary measures suitable for minors.
