改革开放四十年民法学家对宪法学的贡献

摘　　要：民法学家提出的宪法非优位论、民法宪法同位论、民法的宪法功能论等,是对民宪关系学说的丰富和发展。民事立法内容合宪论、民事立法程序合宪论、民事立法权非来源宪法论、民事立法宪法根据陷阱论等,对民事立法与宪法关系的中国语境进行了较好的阐释。民法规范合宪解释论、基本权利第三人间接效力论、援引宪法保护人格权论、基本权利保障义务适用私法强者论等,对民事司法与宪法关系的中国语境进行了合理的解释。社会主义宪政论、宪法起源民主生活论、私法立宪主义论、人格权宪法权利论等,是对宪法学基本理论的突破和发展。民法学家应当继续采取规范主义进路,以宪法规范为中心,拓展部门宪法学研究的新领域,尝试借鉴政治宪法学的研究成果,构建和发展民事政治学的学科体系。The theory of constitutional non-superiority,the theory of constitutional equality of Civil Law and the theory of constitutional function of Civil Law has been put forward by civil jurists.These theories enrich and develop the relationship of Civil Law and Constitutional Law.The content of civil legislation conforming to constitutionalism, the procedure of civil legislation conforming to constitutionalism,the civil legislative power does not deriving from constitutionalism and so on,which have been given a clear explanation of the relationship between the China's civil legislative power and constitution.There are many theories in norm of the Civil Law,such as constitutional interpretation,the theory of basic rights and indirect effect.These theories have been given a reasonable explanation to the relationship between China's civil legislative power and constitution ,while the constitutional theory of socialism , the constitution deriving from life theory,the constitutionalism of private law and so on are major breakthrough and development of the basic theories of Constitution Law. Based on constitutional norms,expanding the new field of civil Constitutional Law and trying to draw upon the research results of political Constitutional Law,civil jurists should continue to take a normative approach and build as well as develop the discipline system of civil politics.
